Yes, if it was for a child with an IEP. Under special education rules, each time a district does an evaluation, if a parent disagrees with the results, the parent can request an Independent Educational Evaluation at district expense. An FBA that looks at an individual’s child’s behavior is a type of evaluation, so if a parent disagrees with the results, the parent can request an IEE at public expense.The district either can agree, or must initiate a due process hearing to defend its own evaluation.
